On April 19, 2024, the tenant transmitted a $5,000 Wells Fargo wire to satisfy the first payment of the Year-3 lease term. This payment was delivered, logged, and acknowledged by the owner’s agent. Despite this, the owner later represented to the Court that “no payment was received,” using the fabricated non-payment narrative as grounds for eviction.
This single transfer destroys the “non-payment” basis for eviction. Once payment is perfected, the owner cannot lawfully proceed with a 3-day notice or unlawful detainer. This evidence establishes both motive and pattern: concealment of payment to engineer eviction for profit.
