This photograph captures visible water damage from an undisclosed roof leak at the rental property. No walkthrough inspection was conducted by Sun Realty or the landlord prior to tenant move-in, and the leak was concealed by a superficial coat of paint rather than repaired. The circular brown stains on the ceiling indicate long-term moisture intrusion.

The landlord’s failure to disclose or repair this defect constitutes violations of California Civil Code §§1941.1 and 1942.4 and Health & Safety Code §17920.3, which require that leased properties remain weatherproof and structurally safe. The omission of a move-in inspection and concealment of known damage demonstrate fraudulent nondisclosure and a breach of the warranty of habitability.

This condition correlates with tenant complaints and certified mail to Consensys Property Management (see Exhibit T9), documenting that repair requests were made but ignored, and that the defect was ongoing during the tenancy.
